The Model NESLi2 Licence for JournalsThe Model NESLi2 Licence for Journals is the model licence used by JISC staff or its agents in negotiations with publishers for JISC journal agreements. It is based on the Model NESLI Site Licence used by the NESLI Managing Agent in negotiations with publishers for NESLI agreements (which was in turn based on the PA/JISC draft model licence) and was approved by the JISC's NESLI Steering Group in 1999 for use by the NESLI Managing Agent. The Model NESLi2 Licence is part of the JISC Collections Contract which is signed by the Publisher concerned and JISC Collections. A small number of changes were made (September 1999) to the Licence to reflect some practical procedures involved, to improve the wording and to clarify some issues. Further changes (July 2001) were agreed by the NESLI Steering Group in March 2001; these changes allow for collaborative archiving as well as archiving by individual institutions. The Model NESLi2 Licence for Journals was approved in September 2002, after additional changes were made to reflect JISC replacing the NESLI Managing Agent in negotiations, and to allow for the fact that the licence no longer covered service delivery. Further revisions were approved by the Journals Working Group in April 2005, bringing the licence up-to-date with latest developments in the delivery of teaching and learning and the dissemination of research activity in the academic community. The changes made in October 2006, relate to the more recent developments of wireless networks, Shibboleth, electronic repositories and self archiving. Further changes were made in May 2007 relating to an expansion of the Authorised Users and Secure Authentication definitions, dark archives used by the publisher and an indication of compliance with Project Transfer, and in September 2008, the dark archives clause was strengthened and some minor changes were made to the Schedules to tighten-up the wording regarding subscription periods and fees. In May 2009, the model licence was amended for 2010. Additions included provisions regarding the permission to make use of the Licensed Material for text and data mining, as well as a new requirement on publishers to provide information on the licensed material to A-Z lists and link resolver vendors.
